1. Scope
1.1 These General Terms and Conditions (“GTC”) apply to all business relationships between schumbera.com, operated by Calvin Schumbera, hereinafter referred to as “schumbera.com”, and the users of the platform.
1.2 The GTC apply in particular to:
• use of the platform,
• creation of user accounts,
• digital travel planning,
• individual travel planning,
• mediation of tourist services,
• requests to hotels, guides, and other service providers,
• own trips and group trips by schumbera.com,
• all related services.
1.3 Users within the meaning of these GTC may be consumers or entrepreneurs.
1.4 A consumer within the meaning of these GTC is any natural person who enters into a legal transaction for purposes that are predominantly outside their trade, business, or profession.
1.5 An entrepreneur is any natural or legal person or partnership with legal capacity who acts in the exercise of their trade, business, or profession when concluding a legal transaction.
1.6 Deviating terms of the user only apply if expressly agreed to in writing.

3. Services of schumbera.com
3.1 schumbera.com operates a digital travel and mediation platform.
3.2 Via the platform, users can in particular:
• create travel plans,
• plan trips individually,
• use travel templates,
• share trips with other users,
• adjust travel components,
• request hotels,
• request guides,
• request tours,
• mediate travel offers,
• submit reviews,
• upload images,
• create PDF exports,
• generate calendar exports
3.3 Unless expressly stated otherwise, schumbera.com acts exclusively as a mediator of tourist services.
3.4 Contracts for mediated services are concluded exclusively between the user and the respective hotel, guide, travel provider, or other service provider.
3.5 In the case of pure mediation services, schumbera.com does not owe the performance of the trip or individual travel components.
3.6 Where schumbera.com offers its own trips, group trips, or guided tours, schumbera.com itself becomes the contractual partner of the traveler.
3.7 Own organized trips are package travel within the meaning of Sections 651a et seq. BGB insofar as several travel services are offered in combination.
3.8 Own organized trips will only be offered once the legally required insolvency protection, including a security certificate, is in place.
4. User Accounts
4.1 Certain functions require the creation of a user account.
4.2 Registration is permitted only for adults with full legal capacity.
4.3 Minors may participate exclusively as fellow travelers but may not make bookings or conclude contracts.
4.4 The user is obliged to provide all information truthfully and completely.
4.5 Access data must be treated confidentially and must not be passed on to third parties.
4.6 The user is liable for all activities carried out via their user account insofar as they are at fault.
4.7 schumbera.com is entitled to temporarily or permanently suspend user accounts in the event of violations of these GTC, misuse, fake bookings, manipulation, or unlawful conduct.
5. Travel Planning Tool and Digital Content
5.1 schumbera.com provides digital tools for individual travel planning.
5.2 Travel suggestions, price information, availability, time information, route suggestions, or recommendations are provided on a non-binding basis only.
5.3 There is no entitlement to permanent availability of specific services, hotels, prices, tours, or travel components.
5.4 Price changes, availability changes, technical errors, exchange rate fluctuations, or short-term changes by service providers remain reserved.
5.5 Travel plans can be individually adjusted by the user.
5.6 Travel plans may be shared privately only with registered fellow travelers.
5.7 Public redistribution, reproduction, or commercial use of the content without the consent of schumbera.com is prohibited.
5.8 PDF exports and calendar exports are for informational purposes only.
5.9 schumbera.com assumes no liability for the accuracy of automatically generated content.
6. Mediation of Tourist Services
6.1 In the mediation of tourist services, the contract is concluded exclusively between the user and the respective service provider.
6.2 Service providers may include in particular:
• hotels,
• tour guides,
• travel operators,
• airlines,
• transport providers,
• tour providers,
• other tourist providers.
6.3 schumbera.com assumes no liability for the proper performance of services by the respective provider.
6.4 Information on prices, services, availability, or travel components is based on the information provided by the respective providers.
6.5 schumbera.com is not obliged to check the providers’ information for accuracy, completeness, or timeliness.
6.6 If users combine several services, this does not create a package trip by schumbera.com in the case of pure mediation.
6.7 The user will be expressly informed during the booking process if only individual contracts with various service providers are concluded.
7. Own Trips and Group Trips by schumbera.com
7.1 schumbera.com may offer its own group trips, active tours, hiking trips, cycling tours, ski trips, and adventure trips.
7.2 For these trips, schumbera.com itself becomes the contractual partner of the traveler.
7.3 The services are determined by:
• travel descriptions,
• advertisements,
• individual offers,
• booking confirmations,
• travel documents.
7.4 The hotels, guides, accommodations, routes, or program items shown may be changed for organizational, safety-related, weather-related, or capacity-related reasons.
7.5 schumbera.com is entitled to provide equivalent substitute services.
7.6 Changes are permissible provided they do not substantially impair the overall character of the trip and are reasonable for the traveler.
8. Conclusion of Contract
8.1 The presentation of trips, services, or offers on the platform does not constitute a binding offer.
8.2 Only the booking or request by the user constitutes a binding contractual offer.
8.3 A contract is concluded only upon express confirmation by schumbera.com or the respective service provider.
8.4 Booking confirmations may be issued electronically.
8.5 The user is obliged to check booking documents immediately for accuracy.
8.6 Errors or deviations must be reported immediately.
9. Prices and Payment Terms
9.1 A separate planning fee may be charged for travel planning individually created by schumbera.com.
9.2 If the user uses only the digital planning tool independently, no planning fee is charged.
9.3 Voluntary tips or donations are possible.
9.4 For own trips, the prices stated in the respective offer apply.
9.5 After receipt of the travel confirmation and, where legally required, the security certificate, a deposit of up to 20% of the travel price becomes due.
9.6 The remaining amount is due no later than 28 days before the start of the trip.
9.7 If payment is not made on time, schumbera.com may withdraw from the contract after issuing a reminder and setting a reasonable deadline.
9.8 Payments can be made in particular by:
• bank transfer
• PayPal
9.9 Fees charged by payment service providers or banks shall be borne by the user to the extent permitted by law.
10. Cancellation and Withdrawal by the Traveler
10.1 The traveler may withdraw from the contract at any time before the start of the trip.
10.2 The decisive factor is receipt of the withdrawal declaration.
10.3 In the event of withdrawal, the following cancellation costs apply unless otherwise agreed:
• up to 28 days before the start of the trip: free of charge
• 27 to 14 days before the start of the trip: 70%
• 13 to 7 days before the start of the trip: 80%
• from 6 days before the start of the trip, on the day of travel, or in case of no-show: 90%
10.4 The traveler remains entitled to prove that lower costs were actually incurred.
10.5 For mediated services, only the terms and conditions of the respective service provider apply.
10.6 Rebookings within the respective free rebooking periods are generally possible free of charge.
10.7 Name changes after expiry of the free rebooking period may be charged with a processing fee of EUR 40 per booking.
11. Withdrawal and Service Changes by schumbera.com
11.1 schumbera.com may withdraw from the contract before the start of the trip if:
• the minimum number of participants is not reached,
• force majeure occurs,
• safety risks exist,
• official measures make this necessary,
or if performance becomes economically or organizationally unreasonable.
11.2 In this case, payments already made will be refunded without undue delay.
11.3 Further claims exist only within the framework of mandatory statutory provisions.
12. Minimum Number of Participants
12.1 A minimum number of participants may be specified for group trips.
12.2 The respective minimum number of participants is stated in the respective offer.
12.3 If the minimum number of participants is not reached no later than 28 days before the start of the trip, schumbera.com may cancel the trip.
12.4 Payments already made will be fully refunded.
13. Force Majeure and Extraordinary Circumstances
13.1 If unavoidable, extraordinary circumstances exist that significantly impair the performance of the trip, both contractual parties may terminate the contract.
13.2 These include in particular:
• natural disasters,
• wars,
• political unrest,
• pandemics,
• official measures,
• strikes,
• extreme weather conditions,
• safety risks,
• entry bans.
13.3 Otherwise, the statutory provisions apply.
14. Rebookings and Name Changes
14.1 There is no entitlement to rebooking.
14.2 Where rebookings are possible, additional costs charged by the respective service provider may be passed on.
14.3 Name changes after expiry of free deadlines may be charged at EUR 40 per booking.
15. Obligations of the User / Traveler
15.1 The user is obliged to provide all information correctly and completely.
15.2 The user is obliged to carefully check travel documents, names, travel dates, and documents.
15.3 The traveler is personally responsible for:
• valid travel documents,
• visas,
• vaccinations,
• entry requirements,
• health requirements,
• customs regulations,
• foreign exchange regulations.
15.4 The traveler must follow the instructions of tour leaders, guides, and safety officers.
15.5 Dangerous behavior, significant disruption, violence, discrimination, drug abuse, or serious violations of safety instructions may lead to exclusion from the trip.
15.6 In this case, there is no entitlement to a refund.
16. Health Requirements and Personal Responsibility
16.1 The traveler is personally responsible for being physically and medically suitable for the respective trip.
16.2 This applies in particular to:
• hiking trips,
• cycling tours,
• ski and outdoor activities,
• long-distance travel,
• active programs.
16.3 Allergies, health restrictions, or special needs must be communicated in good time.
16.4 schumbera.com does not guarantee that special requests or medical requirements will be fully implemented by service providers.
16.5 Medication, personal aids, and medical care are the responsibility of the traveler.
16.6 schumbera.com does not provide medical advice.
17. Travel Insurance
17.1 Taking out suitable travel insurance is expressly recommended.
17.2 This applies in particular to:
• international health insurance,
• travel cancellation insurance,
• trip interruption insurance,
• accident insurance,
• luggage insurance.
17.3 The user is personally responsible for adequate insurance coverage.
18. Outdoor, Activity and Sports Offers
18.1 Participation in outdoor and activity offers is generally at the participant’s own risk.
18.2 The traveler is aware that activities such as hiking, cycling tours, winter sports, sightseeing, or nature tours involve typical risks.
18.3 The traveler undertakes to bring suitable clothing, equipment, and physical fitness.
18.4 Safety decisions made by the tour leader are binding.
18.5 Routes, program items, or activities may be changed at any time for safety reasons.
19. Service Changes and Substitute Services
19.1 Changes to individual travel services remain reserved, provided they are not significant.
19.2 This applies in particular in the event of:
• weather changes,
• natural events,
• official orders,
• safety risks,
• failures of service providers,
• overbookings,
• traffic problems.
19.3 Equivalent substitute accommodations, substitute routes, or substitute services are permissible.
20. Communication via the Platform
20.1 Communication between users and service providers should take place exclusively via schumbera.com.
20.2 The disclosure of personal contact details outside the platform may be restricted.
20.3 Providers may not specifically encourage users to bypass the platform.
20.4 schumbera.com is entitled to moderate messages or content where necessary for security or abuse prevention.
21. Providers, Hotels and Guides
21.1 Hotels, guides, and other providers may provide content, images, and information about their services.
21.2 Providers are responsible for their own information.
21.3 Providers may reject requests.
21.4 Price changes and availability changes remain reserved.
22. Reviews, Images and User Content
22.1 Users may publish reviews and images.
22.2 The user warrants that they hold all necessary rights to uploaded images and content.
22.3 Unlawful, offensive, discriminatory, or copyright-infringing content is prohibited.
22.4 schumbera.com is entitled to review, moderate, or remove content.
22.5 By uploading content, the user grants schumbera.com a temporally and geographically unrestricted right of use to display the content on the platform.
23. Photo, Video and Media Recordings
23.1 Photo and video recordings may be created during trips or events.
23.2 Publication takes place exclusively within the framework of statutory provisions.
23.3 Users may object to the use of their recordings at any time with effect for the future.
23.4 The objection may be submitted by email or by post.
24. Liability of schumbera.com
24.1 schumbera.com is liable without limitation in cases of intent and gross negligence.
24.2 In cases of simple negligence, schumbera.com is liable only for breaches of essential contractual obligations.
24.3 Liability is limited, to the extent permitted by law, to the foreseeable damage typical for the contract.
24.4 The limitations of liability do not apply in cases of:
• injury to life, body, or health,
• mandatory statutory liability,
• claims under the Product Liability Act.
25. Limitation of Liability for Mediated Services
25.1 In the case of mediated services, only the respective service provider is liable.
25.2 schumbera.com is not liable for:
• service disruptions,
• flight changes,
• hotel defects,
• guide cancellations,
• price changes,
• insolvency of service providers,
• service changes by third parties.
25.3 The terms and conditions of the respective provider apply to mediated services.
26. Technical Availability of the Platform
26.1 schumbera.com endeavors to ensure the platform is available with as few interruptions as possible.
26.2 However, permanent accessibility cannot be guaranteed.
26.3 Maintenance work, technical disruptions, security updates, or force majeure may lead to restrictions.
27. Exclusion of Users / Account Suspension
27.1 schumbera.com is entitled to temporarily or permanently suspend user accounts if:
• these GTC are violated,
• misuse occurs,
• fake bookings are made,
• content is unlawful,
• safety risks exist,
• other users are endangered.
27.2 Further claims remain reserved.
28. Data Protection
The separate privacy policy of schumbera.com applies and can be viewed at https://schumbera.com/de/datenschutz.
29. No Right of Withdrawal for Travel Services
29.1 For contracts concerning travel services, leisure activities, accommodation, or date-specific services, there is generally no right of withdrawal pursuant to Section 312g para. 2 no. 9 BGB.
29.2 This applies in particular to:
• group trips,
• accommodations,
• tours,
• leisure activities,
• events,
• guided trips.
30. Dispute Resolution
30.1 The European Commission provides a platform for online dispute resolution:

30.2 schumbera.com is neither obliged nor willing to participate in dispute resolution proceedings before a consumer arbitration board.
31. Place of Jurisdiction and Applicable Law
31.1 The law of the Federal Republic of Germany applies exclusively.
31.2 Statutory places of jurisdiction apply to consumers.
31.3 If the user is a merchant, a legal entity under public law, or a special fund under public law, the place of jurisdiction is Syke.
32. Severability Clause
Should individual provisions of these GTC be or become invalid in whole or in part, the validity of the remaining provisions shall remain unaffected.
